payment policy

We accept payment via Paypal, eTransfer (tayneandashley@gmail.com), Wave via Invoice, Square, Etsy, this very website, check (made payable to Tayne and Ashley Illustration & Design [T&A]), or cash for all our products and custom work. If you send a check, please understand that I have to wait for the check to clear before I begin custom work or send a product to you. For medium to large custom projects ($250+), I can accept either a deposit payment (50%) or full payment up front. Unfortunately we cannot begin work without payment. For smaller projects ($249 and lower), we require full payment up front.

shipping policy

Buyer is responsible for all shipping costs. We recommend and our go to shipping method is Canada Post Expedited Parcel for Canadian orders and USPS via Chit Chats for US, but we are happy to ship UPS or Fed-Ex. International buyers are welcome here.

return, refund, & exchange policy

Custom Orders: If you cancel your order before we begin work on it, Tayne & Ashley Illustration and Design will refund you in full. If we have begun work on your order, please understand that Tayne & Ashley Illustration and Design will need to be compensated for our time. Dually, you will be issued a partial refund. We cannot offer refunds on completed custom orders due to the custom nature.

For custom work, Tayne and Ashley involve you in every step of the design and will send you samples as we work on it, so if you are not liking how it is shaping up, please let us know and we will modify appropriately. If your work is lost or damaged in the mail, we can offer a refund or a re-do if the item is insured. Unless you tell us otherwise, we will purchase insurance with the shipping. T&A packages all of our items extremely carefully, but even so there is the chance of damage or misplacement on the mail carrier’s part.

Readymade Products: For digital products, no refund request can be accommodated. Due to the instant download nature of the product, T&A cannot offer any refunds. If you are unhappy with the product, contact us with suggestions for modifying the product to fit your needs. If your suggestions are in line with what would be useful for other clients as well, T&A will grant your request. For readymade products such as art prints, refunds may be granted provided you let me know why you are unhappy with the product. If the product arrives damaged, please send a photo and T&A will be happy to replace your order.

legal terms

All clients must read and agree to the points laid out below. By entering into a business relationshipwith Tayne & Ashley Illustration and Design, you (the Client) agree and consent to the following terms and conditions: general Tayne & Ashley Illustration and Design will carry out work where an agreement is provided either by email, telephone, mail, Etsy conversation, or Facebook business page (Tayne & Ashley Illustration and Design). An ‘order’ is deemed to be a written or verbal contract between Tayne & Ashley Illustration and Design and the Client.

payment

For PayPal payments, Square, or eTransfer payments, the Client has the option of paying in full up front or making a 50% deposit of the total cost of the design [See “Deposit Payments”]. If the work is quoted at under $250, payment is due in full beginning design work. If you choose to make a deposit, the remaining balance will be invoiced to you along with the completed design. Payment is required within three business days. Oncea design has been completed and approved, the final balance is then due. There are NO exceptions to this; e.g. if the Client decides s/he no longer wants the design, as they have commissioned the work and paid a deposits/he is still obligated to pay for the work that has been done. Non-payment will result in legal action being taken if necessary. Once full payment is received for a design, it is assumed that the project has been completed to the client’s satisfaction and no refunds can be offered. For payments made by check, the amount must be paid in full. The check must clear before any work can be completed.

abandoned status

If the Client should abandon a project or contract after work has commenced (no contact within 21 days), the deposit will be lost. Please understand that once a project has started, it is important to be communicative and see it through until its completion. Dealing with large time intervals is difficult for both the Client and the Designer.

deposit payments

Should the Client choose to make a deposit rather than pay in full, here is the process: The Client pays a 50% deposit of the total cost of the design. For logos, concepts will be sent to the client. For other custom work including illustrations and calligraphy, a preliminary sketch will be sent to the Client.

Based on these concepts or sketches, the Client will choose a design [or approve a design], and Tayne & Ashley Illustration and Design will move forward with that Design.

For logos, revisions will be created until the Client is satisfied, with the fourth and subsequent logo revisions costing $60 / per hour in 1/2 hour increments. For other pieces [custom calligraphy & illustration], there are no revisions due to the physical/tangible nature of the commissioned product [unless it is a digital item]. Once the Client accepts the design {or if the Client is not heard from within three business days}, the remaining balance will be invoiced to you.

If payment is not received within 14 business days, a late payment charge of 10% of the total order will apply to the balance.

Abandoned Status: Deposit Payments If a client should abandon a project or contract after work has commenced [no contact within 21 days], an invoice shall be issued for the full quoted amount, regardless of project status on abandonment. Abandoned contracts in cases where the Client is non-responsive are also subject to an accelerated collections policy, and will be submitted to a third-party collections agency if not paid or addressed within 30 days.

timeframe and delivery

Tayne & Ashley Illustration and Design will provide the initial draft concepts to the Client within the timeframe agreed upon in the initial consultation. Tayne & Ashley Illustration and Design will post the initial sketch or designs in an email, Etsy conversation, or Facebook Business page direct message. The Client will then be able to view his/her draft design/s and also be able to provide feedback concerning the design. Tayne & Ashley Illustration and Design will analyze the Client’s feedback and revise the designs. The revised samples will be presented to the Client within a specified timeframe.

Regular working days are Monday through Friday, 5 pm – 9 PM EST and some select hours on the weekends,  excluding Canadian holidays. Once the Client has approved the final design, the Client will complete any remaining payment owed, and Tayne & Ashley Illustration and Design will then proceed with the delivery phase. If dealing with a digital product, all specified formats of the design are then emailed to the client for his/her use. If the product is physical, it will be mailed by the client’s preferred carrier [default is Canada Post for Canadian Orders & USPS Priority Mail for US orders].

copyright and trademarks

Designs remain the property of Tayne & Ashley Illustration and Design until all outstanding accounts are paid in full. Logos created by Tayne & Ashley Illustration and Design become copyrighted by the Client, but Tayne & Ashley Illustration and Design reserves the right to display these designs on Tayne & Ashley Illustration and Design website, social media or printed portfolio. Tayne & Ashley Illustration and Design cannot take responsibility for any copyright infringements caused by materials submitted by the Client. The Client unconditionally guarantees that any element of text or graphics supplied to Tayne & Ashley Illustration and Design for inclusion in the design do not infringe on any copyright or trademarks that have been already established by another company or organization. The Client will hold harmless and protect Tayne & Ashley Illustration and Design from any claim or suit arising from the use of such as supplied by the client. Tayne & Ashley Illustration and Design will carry out no research or checking on the legal availability of the name they are creating designs for. It is the Client’s responsibility to ensure that the name of their product, company or service is not already in use, and it is the Client’s sole responsibility to secure a service mark or trademark to protect the rights to any name or image. Tayne & Ashley Illustration and Design will not be held responsible for any legal action that may result from improper due diligence on the availability of a company name or image. Tayne & Ashley Illustration and Design reserves the right to display design work in their portfolio (both printed and digital).

Scrapped designs are the property of Tayne & Ashley Illustration and Design. If you do not approve an illustration or logo design concept, it may be used for another Tayne & Ashley Illustration and Design project.

revisions

The initial price quote assumes a reasonable, average number of revisions per design item; but on very rare occasion, a project arises in which the Client requests an additional amount of drafts or revisions.

For logos, three (3) revisions are included. The fourth and subsequent revisions will incur a cost of $60 / per hour in 1/2 hour increments.

For other digital work including invitations and tattoo design, two (2) revisions are included. The third and subsequent revisions will incur a $30 / per hour fee in 1/2 hour increments.

On physical work [calligraphy, illustrations], the Client cannot make revisions to the final product. If the Client requires the work to be re-done, the Client will pay the full amount for the first completed work, and the full amount for the second completed work. Tayne & Ashley Illustration and Design creates preliminary sketches to prevent this situation, so please pay attention to these sketches.

shipping policies

These policies apply only to tangible/physical goods purchased from Tayne & Ashley Illustration and Design.

I am willing to accommodate the Client in his/her shipping preferences. We recommend Canada Post Expedited Parcel with insurance for domestic orders, USPS Priority mail via Chit Chats for US orders, and Fed-Ex or UPS for international orders.

If the Client declines to purchase insurance and the package arrives damaged, Tayne & Ashley Illustration and Design is not liable and will not issue a refund in any amount.

If insurance has been purchased, it is the client’s responsibility to:

  • Provide photos of the damaged product to Tayne & Ashley Illustration and Design so the damagecan be confirmed and we can begin work on a replacement.
  • File an insurance claim with USPS, or another shipping provider, if applicable [where damagedproduct photos will also be submitted]. Tayne & Ashley Illustration and Design is happy to walkthe Client through this if any confusion arises.
  • Insurance payments will be made to Tayne & Ashley Illustration and Design, if the Client desiresa replacement product. If the Client does not want a replacement product, the Client will be the recipient of the insurance payment.

cancellations

Cancellations will be considered only if the request is made within 24 hours of placing an order and we havenot begun work on the order. However, the cancellation request will not be entertained if the orders have been communicated to Tayne & Ashley Illustration and Design, and we have initiated the process of working on these orders. If Tayne & Ashley Illustration and Design is unable to complete the design [due to an emergency situation] your payment will be refunded in full. Tayne & Ashley Illustration and Design has the right to refuse work on a project. If payment has been made and refusal occurs, Tayne & Ashley Illustration and Design will refund the payment in full. 

refuse / decline

Tayne & Ashley Illustration and Design has the right to refuse work on a project. Refusal or decline does not need to be disclosed by Tayne & Ashley Illustration and Design. Reason for decline or refusal could be not a good fit, workload is currently full, or the task is outside their offerings. If payment has been made and refusal occurs, Tayne & Ashley Illustration and Design will refund the payment in full.

confidentiality

When Tayne & Ashley Illustration and Design receives your transmission of personal information, the information is treated as strictly confidential. Tayne & Ashley Illustration and Design will never willfully disclose your personal information to any third party without your written consent or authorization, except as required by any applicable federal, state or local law or regulation. We can only deal directly with the party placing the order, and we are unable to deal with any intermediaries / third parties.

We are happy to sign non-disclosure agreements, and take them very seriously.

working hours

Working hours are Monday through Friday, 5 PM – 10 PM EST and Saturday & Sundays from 8 AM- 1 PM (excluding Canadian holidays).
